U.S. Supreme Court to hear ATA appeal against Michigan truck fee

The U.S. Supreme Court has decided to review the American Truck Associations’ (ATA) allegation that Michigan’s $100-per-truck annual regulatory fee for trucks registered to operate in intrastate commerce violates the Commerce Clause, the trade group said.

ATA alleges the fee discriminates against out-of-state motor carriers and acts as a barrier to their entry into the intrastate transportation market.

The arguments will be filed in April, with a decision likely in late June or early July 2005.
