On August 23, Service Professionals, Inc. withdrew its complaint against the American Trucking Associations (ATA) and Continental DataGraphics (CDG) in which it alleged anti-competitive and exclusionary activities related to the ATA’s Technology and Maintenance Council service offering of the TMC FleetPortal, according to a recent statement from ATA.
In response to the complaint, both ATA and CDG filed motions to dismiss, denying any type of anticompetitive or antitrust behavior and noting that Service Professionals failed to state a claim recognized under the law.
TMC FleetPortal is operated on behalf of ATA through an arrangement with CDC (www.cdgnow.com). The system is designed to provide fleet maintenance personnel with online access to illustrated parts catalogs, repair and maintenance manuals, service bulletins, parts information letters and other internally generated documents as well as TMC Recommended Practices and Vehicle Maintenance Reporting Standards codes (VMRS 2000).
