Teamsters win court battle vs. Overnite

The U.S. Court of Appeals for the fourth circuit recently rejected an appeal by Overnite Transportation Co. and affirmed a National Labor Relations Board (NLRB) order demanding that the company immediately recognize and begin negotiating with the Teamsters at terminals in Lexington, KY, Bowling Green, KY, Buffalo and Detroit. The U.S. Court of Appeals for the fourth circuit recently rejected an appeal by Overnite Transportation Co. and affirmed a National Labor Relations Board (NLRB) order demanding that the company immediately recognize and begin negotiating with the Teamsters at terminals in Lexington, KY, Bowling Green, KY, Buffalo and Detroit.

Workers at those terminals voted for Teamster representation in 1995 and 1996, "only to have Overnite subvert the democratic process through a deceitful misuse of the legal process to deny those workers a place at the contract-negotiating table," the Teamsters said.

The Teamsters have been on strike against Overnite since October 1999.
