A notice of proposed rulemaking (NPRM) to address truckers’ hours of service (HOS) regulations will be published on the Federal Register on Jan. 24, according to the Federal Motor Carrier Safety Administration (FMCSA). The NPRM is currently on display at the office of the Federal Register.
FMCSA is urging the trucking industry to respond to the NPRM. However, the comment period will be shortened to a Mar. 10 deadline, because of the expedited schedule for completing the HOS rulemaking. The agency also noted that the current HOS rules would remain in effect no later than Sept. 30, 2005 under the terms of the Surface Transportation Act of 2004.
The agency is publishing rulemaking in response to a July 2004 decision by the U.S. Court of Appeals for the District of Columbia Circuit, which vacated the rules.
