Canadian Trucking Group Backs HOS Stay

The Canadian Trucking Alliance has backed the Federal Motor Carrier Safety Administration

The Canadian Trucking Alliance (CTA) has backed the Federal Motor Carrier Safety Administration (FMCSA) by a filing a motion to the Washington D.C. Circuit Court of appeals urging a stay for the current hours of service (HOS) rules.

The Court’s July 16 ruling, which declared the rules “arbitrary and capricious,” has galvanized the trucking industry as CTA joins the American Trucking Assns. (ATA), Commercial Vehicle Safety Alliance, and Truckload Carriers Assn. (TCA), in an effort to keep the rules in place until FMCSA can revise HOS to address the Court’s ruling.

“No party to the proceeding represents the thousands of Canadian trucking companies that will be affected by this Court’s decision whether to require the FMCSA to revert back to its former HOS regulations or allow the current rules to remain in effect while the agency fulfills its requirements set forth in this Court’s July 16 decision,” stated CTA.

The Canadian trucking industry would face “significant and unwarranted” costs if the current rules were vacated, CTA said.

The prosecutor, Public Citizen, is expected to file a response to the FMCSA’s request for a stay on Monday.
