DFC Transportation alleges illegal competition from former officers

Refrigerated carrier DFC Transportation, Huntley IL, has filed suit in Illinois county court against Kelly Scott Harm, Barry Kevin, Susan Serio, and Cheri McNall and their newly formed company K&S Transportation. The suit claims that the former officers of DFC have solicited shippers and agents of DFC in violation of their agreement not to compete. The suit also charges the defendants with breach of contract and claims they have breached the Illinois trade secrets act. DFC says it can trace $3 million in lost business to the actions of the defendants. A preliminary injunction was issued in favor of the company on July 1, 2002. DFC Transportation was sold by Dean Foods earlier in 2002 as a part of its merger with Suiza Foods.
