    The U.S. Court of Appeals for the District of Columbia Circuit has granted the American Trucking Assns.’ request to intervene in a Public Citizen-led challenge to the revised hours-of-service (HOS) rule that went into effect in 2005.

    The next step is for the interveners-- including NASSTRAC Inc., The Health and Personal Care Conference, Inc., and United Parcel Service—to file a joint brief supporting the challenged aspects of HOS. No briefing schedule has been set yet and ATA expects the lawsuit to conclude no sooner than spring 2007.

    The trucking trade group expects Public Citizen to challenge the rule’s 11-hour daily driving limit, the 34-hour restart, and FMCSA’s decision to exclude an EOBR mandate from HOS.
