TCA to hold criminal records and driver screening webinar

The Truckload Carriers Assn. will hold a webinar titled “Criminal Records and Driver Screening: The Newest EEOC Guidelines” on Thursday, June 21, from noon to 1:30 p.m. EST. Those attending will learn how to avoid violating the newest guidelines from the Equal Employment Opportunity Commission (EEOC) when hiring drivers and other staff.   

Do you ask about criminal convictions on your driver application?  If so, you may be in violation of new guidelines from the EEOC, according to TCA.  

EEOC guidelines spell out how fleets can and cannot use criminal records in the screening and hiring of drivers and other staff.  EEOC based its guidance on the premise that the use of criminal records across the board is inherently discriminatory against certain protected classes and could result in a permanent “underclass.”

The guidelines, while not as comprehensive as the original proposal, cover everything from what carriers can ask on an application to the rights of an applicant with a criminal record.  They include how you should document your policy and train your staff.

Other topics to be discussed in the webinar include:

  • What criminal records can be used
  • How far back in time should you consider criminal history
  • What a job description must entail in order to use “applicable” criminal records
  • How pre-adverse notifications must be used

This interactive program will provide opportunities for participants to ask questions.
